The Program Manager, HR Compliance is a pivotal role focused on safeguarding Acosta Group’s integrity by ensuring adherence with relevant labor laws and regulations throughout the U.S. and Canada and supporting a workplace culture where applicants and employees are treated fairly and consistently. Through a proactive and holistic approach, this role will build and maintain a comprehensive view of the HR compliance landscape related to recruiting, hiring, onboarding, and artificial intelligence (AI). This position will oversee the organization’s Affirmative Action Plans and implementation, EEO-1 and state pay data reporting, as well as other regulatory reporting as required.


Responsibilities


  • Hiring & Onboarding Compliance: Collaborate with talent acquisition and IT partners to audit and enhance applicant tracking systems and related processes to ensure compliance with Federal, state and local laws, including but not limited to pay transparency, pre-employment screening, EEO, and AI. Oversee new hire paperwork in all new hire onboarding systems, ensuring consistent and accurate delivery, completion, and retention.
  • OFCCP Compliance & Reporting: Lead compliance efforts in administration of Equal Employment Opportunity (EEO) regulations and requirements per the Office of Federal Contract Compliance Programs (OFCCP). Develop and implement Affirmative Action Plans, including narrative plans, data analysis for goals and utilization, program management, internal audits, and coordination with HR partners. Collaborate with business leaders to review AAP metrics and support the organization in meeting affirmative action goals through actionable strategies. Serve as the primary point of contact for all OFCCP-related inquiries, including coordinating responses and managing enterprise involvement in OFCCP audits or compliance reviews.
  • Compliance Reporting: Responsible for HR compliance and reporting functions including, but not limited to, partnering with data teams to prepare, analyze, and submit data for annual EEO-1, VETS 4212, US Census Bureau Surveys, OFCCP audit responses, Department of Labor requests, and state pay data reporting.
  • Employment Screening: Trusted advisor for employment screening programs including criminal background checks, motor vehicle reports (MVR), drug testing, and related adjudication requirements based on Federal state, local, and provincial laws. Ensure compliance with adverse action and individualized assessment requirements. Educate HR teams and leaders, and support process enhancements based on legislative changes.
  • Immigration Compliance: Educate, monitor, and measure I-9 and E-Verify compliance. Respond to requests and audits as appropriate.
  • Labor Law Poster Compliance: Manage vendor partnership and distribution of required posters to ensure compliance with Federal, state and local labor law posters for the U.S. and Canada.
  • Program Management: Demonstrate strong program management skills to develop, implement, and oversee compliance programs. Develop and present business cases, ensure accurate documentation of compliance processes, identify service level agreements (SLAs), measure key performance indicators (KPIs), and lead continuous improvement activities.
  • Regulatory Compliance: Proactively monitor the complex and rapidly changing network of federal, state, and local employment related laws and regulations. Interpret and breakdown laws and regulations for internal teams to understand quickly and effectively.
  • Change Management: Develop training and resources to ensure management and HR community awareness of fair, equitable, and compliant processes related to interviewing, hiring, and onboarding. Facilitate change management efforts related to compliance programs, ensuring alignment with the audience, organizational objectives, and legal requirements.
  • Measure & Audit: Monitor SLAs and KPIs to ensure timely and effective compliance processes. Report on key metrics to drive continuous improvements and foster an engaging employee experience. Conduct regular audits to ensure compliance with policy and legislation and identify opportunities to improve process discipline, and devise action plans for execution.
  • Policy & Procedure Development: Develop and revise HR policies that support compliance, align with Company standards, and support HR topics at the operational business level. Partner with internal stakeholders to gather feedback on policy effectiveness and make data-driven recommendations for improvement. Create content to support HR Business Partners and leaders with interpreting and managing within the guardrails of policies and the law.
  • Continuous Improvement: Develop and improve processes and programs to support a culture of compliance, continuous improvement, and scalability for future growth.
  • Participate in projects and committees related to HR compliance processes to ensure consistency and compliance across business units.

Qualifications


  • Ten (10) years of progressive human resources and employment compliance experience with multistate experience required; international experience preferred
  • Keen understanding of HR policies and processes, and the ability to implement and monitor compliance programs effectively
  • Detail oriented and analytical with the demonstrated ability to perform work with high degree of accuracy
  • Strong conflict resolution and mediation skills
  • High level of integrity, discretion, professionalism, and sound judgement
  • Strong oral, written, and interpersonal communication skills with the ability to effectively communicate and influence individuals at all levels
  • Solid understanding of confidentiality and privacy-related compliance
  • Ability to work independently and as part of a team
  • Ability to work under pressure and prioritize tasks and projects based on risk levels and business needs
  • Ability to manage multiple projects and activities simultaneously, with a strong ability to work under pressure, prioritize, organize, and deliver results with minimal supervision
  • Solid technical skills, including advanced knowledge of Microsoft Office Suite
  • Available to work extended hours to complete projects and meet business demands, as needed
  • Ability to assess implications of new information and apply to appropriate processes
  • Strong organizational skills with the ability to manage multiple tasks and priorities
