Legal & Compliance Counsel Location: Thornhill, ON
Job Description
Galderma Canada is looking for a highly motivated and experienced professional to support Galderma Canada with compliance governance & processes. The Legal & Compliance Counsel will be responsible for on-site legal and compliance day-to-day activities in support of Prescription, Aesthetic and Consumer business units. This is a multifaceted and important role within the Canadian organization, ensuring adherence to legal & compliance standards, internal policies, and ethical practices. His/her duties will encompass various aspects to safeguard Galderma's integrity and reputation. The right individual should thrive in an ambiguous environment and embrace entrepreneurship and agility. The Legal & Compliance Counsel will help ensure Galderma Canada operates within the bounds of the law, maintains high ethical standards, and minimizes the risk of legal or regulatory sanctions.
Key Responsibilities
Compliance Standards: Ensure compliance of Canadian Affiliate with global standards (e.g. Code of Ethics, global policies, and procedures) as well as local laws and regulations. Supporting implementation of global and/or regional standards and compliance initiatives. Liaise with regulatory bodies and industry groups to stay informed about best practices and changes in the regulatory compliance environment.
Engagement with HCPs: Support review, approval and documentation for local HCP engagement and cross-border activities following relevant policies and procedures, including management of disclosure requirements.
Conflict of Interest (COI): Conduct regular training sessions to educate employees and management about COI policies, potential conflicts, and their duty to disclose such conflicts. Require employees and management to complete regular COI disclosure forms, particularly during onboarding and periodically thereafter. Conduct investigations into reported or identified conflicts of interest to gather facts and determine the severity of the conflict.
Regulatory Compliance: Keep abreast of regulatory changes and ensure Galderma complies with relevant laws and regulations. Maintain and manage documentation related to compliance activities and regulatory requirements. Ensuring compliance with Quality and Pharmacovigilance legal obligations, including relevant Good Pharmacovigilance Practices and Good Manufacturing Practices.
Risk Management: Conduct regular risk assessments to identify potential compliance risks. Develop and implement strategies to mitigate identified risks.
Audits and Inspections: Prepare for and manage internal and external audits and inspections.
Training and Education: Develop and deliver training programs to educate employees on compliance policies, procedures, and legal obligations. Promote a culture of compliance and ethical behavior through ongoing communication and awareness programs. Oversee the effectiveness of the company’s compliance program and foster a culture of integrity and ethical business practices. Train Canadian employees on whistleblower programs to encourage reporting of unethical behavior without fear of retaliation.
Monitoring and Enforcement: Monitor the implementation of compliance policies and procedures across Galderma Canada. Investigate any potential compliance breaches or misconduct. Recommend and oversee corrective actions for any identified compliance issues.
Privacy Compliance: Implement robust data protection measures, maintain up-to-date privacy policies, ensure employee training, conduct regular audits, and establish clear protocols for data handling, retention, and breach response.
Cross-Departmental Collaboration: Work with various departments, including finance, HR, and operations, to ensure a cohesive approach to compliance.
Skills & Qualifications
Minimum of 3 to 5 years of experience in private practice and/or in-house setting is required.
Strong knowledge of laws and regulations applicable to prescription drugs and devices as well as OTC drugs, NHPs and cosmetics is required.
Experience reviewing advertising and promotional materials of pharmaceutical products is preferred.
Must have the ability to handle confidential information and materials in an appropriate manner, and in accordance to organizational policy, proper business practice, and/or appropriate external regulation/governance.
Excellent communication (verbal/written), interpersonal, and organizational/time management skills are required.
A high level of integrity while working under pressure is required.
Ability to function effectively with minimum supervision is required.
Ability to identify problems, collect data, establish facts, and draw valid conclusions.
Employee must be able to multi-task under pressure.
